VOID WHERE PROHIBITED BY LAW. IN THE UNITED STATES AND CANADA, ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. NAME AND PURPOSE. Sorare SAS, is the promoter of the Sweepstakes (“Sorare” or “Sponsor”). Sponsor is holding the Sweepstakes with the intention of promoting and marketing its products and services, where all those who have correctly signed up can participate, in compliance with the provisions of the terms herein. Specifically, a random draw will be held among all those who have participated and who have met the below requirements.

ELIGIBILITY: The Sweepstakes is open worldwide (the “Eligible Territory”) to Users aged eighteen (18) or older at the time of entry. Additionally, you are only eligible if, on or before the close of the Entry Period (defined below). Additionally, you are only eligible if, on or before the close of the Entry Period (defined below), you: 

• Have an active Sorare account; and
• Own a Sorare Card Collection of one SERIE A team with a high enough Collection Score to unlock and equip the club badge, i.e., above four hundred (400) points for Limited, above three hundred (300) points for Rare, above two hundred (200) points for Super Rare, and above eighty (80) points for Unique.
• You must have the club badge equipped on your Manager profile.

VOID WHERE PROHIBITED: Any individual in a country or territory that the U.S. government, European Union and/or United Nations has placed embargo restriction(s) on is not eligible to participate in the Sweepstakes. Additionally, any individual on the U.S. government, European Union or United Nations list of restricted parties or persons (including being a Specially Designated National by the U.S. government) is not eligible to participate in the Sweepstakes. Employees, officers, and directors, and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household (whether or not related) of the Sponsor, SERIE A and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any other entity associated with the Sweepstakes are not eligible to participate or win a prize. “Partner Entities” means Lega Nazionale Professionisti Serie A (“SERIE A”). The Sweepstakes is subject to all applicable laws, rules, and regulations. Void outside the Eligible Territory and where prohibited or restricted by law, rule, or regulation. 

HOW TO ENTER: The entry period begins at 9am Eastern Time (“ET”) / 3pm Central European Time (“CET”) on April 16th, 2024, and ends at 8pm ET / 2pm CET on April 23rd, 2024 (“Entry Period”). By meeting the criteria listed above, or by entering via the alternative method of entry, you agree to these Official Rules and enter into these Sweepstakes. You can also enter in the Sweepstakes via the Alternative Method of Entry (see below). No other method of entry will be accepted. One (1) entry into the Sweepstakes pool will be made for each eligible Entry as outlined above. 

Additional entries beyond the specified limit will be void. Inaccurate or fraudulent entries will be void. Note you will not receive a reply or acknowledgement. 

Alternative Method of Entry: Alternatively, you are eligible to enter via email. To enter via email, send an email with “SERIE A Collector Event” in the subject line to [email protected] and include in the body of such email all of the following information: your full name and the following statement: “I acknowledge that I have read, understand, and agree to the Sweepstakes Official Rules.” Incomplete and/or inaccurate entries are void. Sponsor will use email addresses provided via email for prize notification purposes only. Email entries must be received by the close of the Entry Period. Email entries will not receive a reply or acknowledgement. For the avoidance of doubt, the Alternative Method of Entry is not cumulative with the standard method of entry set forth in section “HOW TO ENTER” of the Sweepstakes. 

RANDOM DRAWING; ODDS: On or about April 23rd, 2024 (“Drawing Date”), fourteen (14) winners will be selected by random drawing from among all entrants who meet the eligibility requirements above, corresponding to one (1) collector for each of the 14 SERIE A teams licensed on Sorare. Subject to verification of eligibility and compliance with these Official Rules, the winners will be declared the official winners of the Sweepstakes. Odds of winning depend on the total number of eligible entries as of the end of the Entry Period.

PRIZE: Fourteen (14) winners will be selected. Each winner will receive one (1) Matchday VIP Experience (Approximate Retail Value: 200 euros). TRANSPORTATION AND LODGING NOT INCLUDED.

PRIZE CONDITIONS: All prize details are determined by the Sponsor and described in these Official Rules. All costs and expenses associated with prize acceptance and use which are not specifically included in the prize description above, including but not limited to transportation, lodging, meals, gratuities, insurance, and other expenses, are the sole responsibility of the winner. The prize is non-transferable and non-assignable, with no cash redemptions. Sponsor reserves the right to substitute the prize (or any portion thereof) with a prize of comparable or greater value. Use of any game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date are determined by the Sponsor. Winners’ guest(s) must be of legal age of majority in their jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Game/event/exhibition dates and times are determined in the sole discretion of the Partner Entities or applicable team,  and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a game/event/exhibition, as defined by the Partner Entities, is not played or held. Winners and their guest(s) may have to comply with applicable venue and event regulations in connection with the prize. Sponsor and the Partner Entities reserve the right to remove or to deny entry to the winners and/or their guest(s) who engage in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any force majeure event that may cause the cancellation or postponement of any game/event/exhibition. Game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies of the Partner Entities including but not limited to the wearing of masks if and when directed and the requirement to be fully vaccinated against COVID-19. 

NOTIFICATION: The winners will be notified via the email address provided (the “Prize Notification“). In the event that any winner does not respond to Prize Notification within two (2) days of the date of issuance or declines the prize for any reason, a disqualification will result, the prize will be forfeited and an alternate winner may be randomly selected from among all remaining eligible entries. The winners may be required to submit their identification information (such as name, surname, address) to the Sponsor for the purpose of receiving the Prize (and may receive, for winners who are residents or citizens of the US, an IRS Form 1099 for any prize valued at $600 or greater). The winners may be required to execute, have notarized, and return an Affidavit of Eligibility to the Sweepstakes and, unless prohibited by law, a Release of Publicity (please see the Publicity Release section below), within five (5) days of the date of issuance. If required in the Eligible Territory, the winners will be required to answer correctly, without assistance of any kind (mechanical or otherwise), a time limited mathematical skill testing question which will be administered by Sponsor by telephone at a mutually agreeable time. Failure to submit any identification required by Sponsor or to return any required documents within the specified time period, noncompliance with these Official Rules, the return of Prize Notification or of the prize (or any portion thereof) as non-deliverable, or, if applicable, failure to answer correctly the skill testing question Sponsor may result in the winner’s disqualification and prize forfeiture and Sponsor may cause an alternate winner to be randomly selected from among all remaining eligible entries.

CONTENT RESTRICTIONS: Entrants must not include any of the following (the “Content Restrictions“) in any entry: (a) nudity, pornography, adult-oriented content, or any other explicit material; (b) materials relating to lotteries or gambling; (c) profanity, images of violence, or promotion of illegal activities; (d) content in violation of intellectual property rights or laws; (e) libelous, defamatory, disparaging, tortious, or slanderous materials; (f) content that denigrates, disparages, or reflects negatively on the Partner Entities, their owners and employees, or the relevant sport; (g) tobacco, e-cigarettes, alcohol, or drugs; (h) dangerous stunts; (i) real weapons of any kind including, but not limited to, guns, knives, or projectiles; (j) material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other basis protected by law, ordinance, or regulation; (k) individuals under legal age of majority without providing a signed release from parent or legal guardian; (l) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (m) material that is unlawful or otherwise in violation of or contrary to the laws or regulations in any jurisdiction where the entry is created. Any entry that does not comply with the foregoing, as determined in the reasonable sole discretion of  Sponsor will be disqualified.

ENTRY PUBLICATION, LICENSE, AND RELEASE: By agreeing to these Official Rules, and to the extent permissible by applicable local law, each entrant (a) agrees that their entry is an original work of authorship and that they own all right, title, and interest in the entry as of the date of submission, or has all necessary rights and authorizations to submit the entry, including the express permission of all individuals embodied in the entry, for possible use as provided herein; (b) agrees that his/her/their entry does not infringe upon the copyright, trademark, or other intellectual property rights, or rights of privacy or publicity, of any person or entity; (c) grants to Sponsor, the Partner Entities and each of their respective designees the unlimited right and license to use, license, edit, modify, duplicate, and/or create derivative works from their entry throughout the world for the duration of protection of the potential intellectual property rights in you entry, including the right for the Partner Entities to publish, display, broadcast, distribute, reproduce, perform, create derivative works from, and otherwise use and exploit the entry via their websites, social media (such as TikTok, Facebook, X, Instagram) in stadium, on television, in print, and/or any other media currently existing and hereafter developed without limitation and without notice or payment of any compensation to the entrant or their heirs and successors: (i) on its own or as part of any audiovisual or other production; (ii) to advertise any products, programming, or services of the Partner Entities for any other advertising, marketing, and promotional purposes and in any materials related thereto and/or (iii) for any other purpose whatsoever; and (d) release in perpetuity the Released Parties (as defined below) from any claims, demands, losses, and liabilities of any nature arising out of or in any way connected with the entry and use thereof as permitted hereunder, including, but not limited to, claims of copyright or trademark infringement, false endorsement, libel, slander, defamation, or infringement of rights of publicity or privacy. Nothing herein will obligate the Partner Entities to make any use of any of the rights set forth herein.

WAIVER OF LIABILITY/PUBLICITY RELEASE (only applicable to US and Canada residents): By entering the Sweepstakes, each entrant agrees to (a) be bound by these Official Rules, including all entry requirements, and (b) waive any and all claims against Sponsor, the Partner Entitiesand each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives, advertising and promotion agencies, and any other company associated with the Sweepstakes, and all of their respective officers, directors, employees, agents, and representatives (collectively, “Released Parties”) for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from participation in the Sweepstakes, receipt or use of the prize (or any portion thereof), or any travel or activity related thereto.

For EU and UK Residents: Nothing in these Official Rules shall exclude or limit the Released Parties liability for (i) death or personal injury caused by the Released Parties, (ii) direct damages resulting from the Released Parties material breach of their legal obligations and/or material breach of these Official Rules or (iii) fraud, fraudulent misrepresentation or gross misconduct.

PUBLICITY RELEASE (not applicable to German and Spanish residents): By agreeing to these Official Rules, participants agree that the Sponsor, the Partner Entities and their designees and assigns may use in relation to the Sweepstakes and for a duration of two (2) years as from the entry into the Sweepstakes, the participant’s name, voice, city/state of residence, photos, video or film clips, for advertising and/or trade purposes in any present or future media, including on their websites, social media pages (TikTok, Facebook, X, Instagram) or sharing platforms (YouTube, Dailymotion), e-banners, promotional emails or present or future format without further compensation (financial or otherwise), permission or notification. The winners grant to Sponsor, Partner Entities and each of their respective designees the right to publicize in relation to the Sweepstakes and the prize for a duration of two (2) years as from the Prize Notification,  their respective name, city and state of residence, prize information, photograph, video or film clips, voice, statements, and/or other likeness for advertising, promotional, trade  purposes, in any present or future media, including on their websites, social media pages (TikTok, Facebook, X, Instagram) or sharing platforms (YouTube, Dailymotion) or format now known or hereafter devised, throughout the world, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.

GENERAL CONDITIONS: Sponsor’s computer shall be the official clock of the Sweepstakes. The decisions of the Sponsor made in accordance with these Official Rules are final and binding on all matters relating to these Sweepstakes. Provided that they are not in breach of their legal or contractual obligations, Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled entries, transmissions, email, or mail; lost, interrupted, or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections; availability, accessibility, miscommunications, or failures of computer, satellite, telephone, cable, or wireless transmissions or lines; computer hardware or software malfunctions, failures, or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines, telephone systems, wireless towers, or cellular tower equipment; any error, omission, interruption, defect, or delay in wireless or other transmission, processing, or communication; printing, typographical, or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements, or other materials, to the extent permissible by applicable law; cancellation or postponement of any game/event/exhibition due to a force majeure event; or any other errors, problems, or difficulties of any kind, whether human, mechanical, electronic, or other, relating to the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with administration of the Sweepstakes, processing of entries, announcement of the winners, or any Sweepstakes-related materials. Provided that they are not in breach of their contractual or legal obligations, Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users (e.g., hacking) or by any equipment or programming associated with or utilized in the Sweepstakes. Unless they are in breach of their contractual or legal obligations, Released Parties are not responsible for damage to entrant’s or to any other person’s computer and/or wireless device related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Sweepstakes website. Persons who tamper with or abuse any aspect of the Sweepstakes or website; attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices; intend to annoy, abuse, threaten, or harass any other entrant or any representative of Sponsor and/or the Partner Entities; or who are in violation of these Official Rules will be disqualified and all associated entries will be void. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes. Released Parties (a) make no warranty, guaranty, or representation of any kind concerning the prize (or any portion thereof) other those provided for herein and (b) disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  Sponsor and Partner Entities reserve the right to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) in the event Sponsor is prevented from executing the Sweepstakes as contemplated herein by any Sponsor’s force majeure event, including but not limited to: fire; flood; earthquake; explosion; public health epidemic or crisis; labor dispute or strike; act of God or public enemy; network or equipment failure; riot or civil disturbance; terrorist threat or activity; war (declared or undeclared); court order; or federal, state, or local government law, order, or regulation. Sponsor and the Partner Entities also reserve the right to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events, qualifying as force majeure, corrupt administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify the winners and award the prize by way of random drawing from among all non-suspect, eligible entries received up to the time of cancellation. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR OTHER PROPERTY ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT AND SPONSOR, THE SPONSOR ENTITIES AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Entries generated by a script, macro, or other mechanical or automated means will be disqualified. In the event of dispute as to the identity or eligibility of any winner, the winning entry will be declared made by the Authorized Account Holder of the email address account used to enter the Sweepstakes, provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person who is assigned to the relevant account by the relevant ISP or other organization (e.g. a business or educational institution). 

ARBITRATION; CLASS ACTION WAIVER (only applicable to US and Canadian residents): As a condition of entering this Sweepstakes, each entrant agrees that (a) any and all disputes, claims, controversies, or causes of action arising out of or relating to this Sweepstakes or any prizes awarded (each, a “Claim“) shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in New York County, New York before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. For New Jersey residents, the limitations set forth above may be inapplicable where attorneys’ fees, court costs, or other damages are mandated by statute. 

GOVERNING LAW AND JURISDICTION:

• If you live outside of the EU, these rules will be governed by the laws of the State of New York. 
• If you live in the EU or UK, the Official Rules are governed by the laws of your country of residence, and you retain the right to bring legal proceedings before any local court of applicable jurisdiction where you live. 
• For Italian residents, the laws of France shall apply to the extent that it does not deprive you of the protection afforded by Italian Law. 

WINNER LIST: For the winners’ names, mail a request and a self-addressed stamped envelope to be received no later than ninety (90) days after the Drawing Date to: SERIE A Collector Event Winner List, c/o 5 Avenue du Général de Gaulle, Saint-Mandé, France 94160.  You may object to the communication of your details in writing by email to [email protected]. 

PRIVACY: By agreeing to these Official Rules and participating in the Sweepstakes, participants hereby acknowledge that the Sponsor may collect and use their personal data in compliance with all applicable laws and regulations and its Privacy Policy accessible at https://sorare.com/privacy_policy in order to organize, run and monitor the Sweepstakes.

COME PARTECIPARE: Il periodo di partecipazione inizia alle 9:00 ora orientale (“ET”) / 15:00 ora dell’Europa centrale (“CET”) del 16 aprile 2024 e termina alle 20:00 ET / 14:00 CET del 22 aprile 2024 (“Periodo di partecipazione”). Soddisfacendo i criteri sopra elencati, o iscrivendovi tramite il metodo alternativo di iscrizione, accettate il presente Regolamento ufficiale e partecipate a questo Concorso a premi. È possibile partecipare al Concorso a Premi anche attraverso il metodo alternativo di iscrizione (vedi sotto). Non saranno accettati altri metodi di iscrizione. Per ogni iscrizione idonea, come sopra indicato, verrà effettuata una (1) iscrizione al Concorso a premi. 

Ulteriori iscrizioni oltre il limite specificato saranno annullate. Le iscrizioni inesatte o fraudolente saranno annullate. Si noti che non si riceverà alcuna risposta o conferma. 

Metodo alternativo di iscrizione: In alternativa, è possibile partecipare via e-mail. Per partecipare via e-mail, inviare un’e-mail con “Evento SERIE A Collector” nell’oggetto a [email protected] e includere nel corpo di tale e-mail tutte le seguenti informazioni: il proprio nome e cognome e la seguente dichiarazione: “Dichiaro di aver letto, compreso e accettato il Regolamento ufficiale del Concorso a premi”. Le iscrizioni incomplete e/o imprecise sono nulle. Lo Sponsor utilizzerà gli indirizzi e-mail forniti solo per la notifica dei premi. Le iscrizioni via e-mail devono essere ricevute entro la fine del Periodo di iscrizione. Le iscrizioni via e-mail non riceveranno risposta o conferma. A scanso di equivoci, il Metodo alternativo di iscrizione non è cumulabile con il metodo di iscrizione standard indicato nella sezione “COME SI ACCEDE” del Concorso a premi. 

ESTRAZIONE A CASO; QUOTE: il 22 aprile 2024 o intorno a tale data (“Data dell’estrazione”), tra tutti i partecipanti che soddisfano i requisiti di ammissibilità di cui sopra, verranno estratti a sorte quattordici (14) vincitori, corrispondenti a un (1) collezionista per ciascuna delle 14 squadre di SERIE A con licenza su Sorare. I vincitori, previa verifica dell’ammissibilità e del rispetto del presente Regolamento Ufficiale, saranno dichiarati vincitori ufficiali del Concorso a Premi. Le probabilità di vincita dipendono dal numero totale di iscrizioni ammissibili alla fine del Periodo di iscrizione.

PREMIO: Saranno selezionati quattordici (14) vincitori. Ogni vincitore riceverà una (1) esperienza VIP nel giorno della partita (valore al dettaglio approssimativo: 200 euro). TRASPORTO E ALLOGGIO NON INCLUSI.

CONDIZIONI DEL PREMIO: Tutti i dettagli del premio sono determinati dallo Sponsor e descritti nel presente Regolamento ufficiale. Tutti i costi e le spese associati all’accettazione e all’uso del premio che non sono specificamente inclusi nella descrizione del premio sopra riportata, inclusi ma non limitati a trasporto, alloggio, pasti, mance, assicurazione e altre spese, sono di esclusiva responsabilità del vincitore. Il premio non è trasferibile e non è cedibile, e non può essere riscosso in contanti. Lo Sponsor si riserva il diritto di sostituire il premio (o parte di esso) con un premio di valore equivalente o superiore. L’uso di qualsiasi biglietto per giochi/eventi/mostre è soggetto ai termini, alle condizioni e alle politiche sanitarie e di sicurezza standard applicabili al biglietto. La posizione dei posti a sedere al gioco/evento/esibizione e, se non diversamente indicato nella descrizione del premio, la data esatta del gioco/evento/esibizione sono determinate dallo Sponsor. Gli ospiti dei vincitori devono essere maggiorenni nella loro giurisdizione di residenza, a meno che non siano accompagnati da un genitore o da un tutore legale. Le date e gli orari delle partite/eventi/esibizioni sono determinati a esclusiva discrezione delle Entità partner o della squadra applicabile e possono essere soggetti a modifiche. I termini e le condizioni dei biglietti assegnati come parte del premio saranno validi nel caso in cui un gioco/evento/esibizione, come definito dalle Entità Partner, non venga giocato o tenuto. I vincitori e i loro ospiti potrebbero essere tenuti a rispettare le norme applicabili in materia di luoghi ed eventi in relazione al premio. Lo Sponsor e le Entità partner si riservano il diritto di rimuovere o negare l’ingresso ai vincitori e/o ai loro ospiti che si comportano in modo antisportivo o di disturbo o con l’intento di infastidire, abusare, minacciare o molestare qualsiasi altra persona durante il gioco/evento/esibizione. Le Parti esonerate (come definite di seguito) non saranno responsabili di condizioni meteorologiche; cause di forza maggiore; atti di terrorismo; disordini civili; regolamenti, ordini o politiche locali, statali o federali; interruzione del lavoro; epidemie, pandemie o qualsiasi altra questione riguardante la salute o la sicurezza pubblica; o qualsiasi evento di forza maggiore che possa causare la cancellazione o il rinvio di qualsiasi gioco/evento/esibizione. I biglietti di giochi/eventi/mostre assegnati come premi non possono essere rivenduti, offerti per la rivendita o utilizzati per qualsiasi scopo commerciale o promozionale. Qualsiasi rivendita o uso commerciale o promozionale di questo tipo può comportare la squalifica e la perdita del premio e può invalidare la licenza concessa dal biglietto del gioco/evento/esibizione. La partecipazione all’evento a premi è soggetta al consenso e al rispetto da parte del vincitore (e del suo ospite) di tutte le norme di salute e sicurezza delle Entità partner, compreso, ma non solo, l’uso di maschere se e quando necessario.

NOTIFICA: I vincitori saranno informati tramite l’indirizzo e-mail fornito (la “Notifica del premio”). Nel caso in cui un vincitore non risponda alla notifica del premio entro due (2) giorni dalla data di emissione o rifiuti il premio per qualsiasi motivo, il premio sarà squalificato, il premio sarà perso e un vincitore alternativo potrà essere selezionato a caso tra tutte le iscrizioni ammissibili rimanenti. Ai vincitori può essere richiesto di presentare i propri dati identificativi (quali nome, cognome, indirizzo) allo Sponsor al fine di ricevere il premio (e possono ricevere, per i vincitori residenti o cittadini degli Stati Uniti, un modulo IRS 1099 per qualsiasi premio del valore di 600 dollari o superiore). Ai vincitori potrebbe essere richiesto di sottoscrivere, far autenticare e restituire una dichiarazione di idoneità al Concorso a Premi e, a meno che non sia proibito dalla legge, una liberatoria per la pubblicità (si veda la sezione Liberatoria per la pubblicità di seguito), entro cinque (5) giorni dalla data di emissione. Se richiesto nel Territorio idoneo, i vincitori dovranno rispondere correttamente, senza alcun tipo di assistenza (meccanica o di altro tipo), a un test di abilità matematica a tempo limitato che sarà somministrato dallo Sponsor per telefono a un orario concordato. La mancata presentazione di qualsiasi documento di identificazione richiesto dallo Sponsor o la mancata restituzione di qualsiasi documento richiesto entro il periodo di tempo specificato, il mancato rispetto del presente Regolamento ufficiale, la restituzione della Notifica del premio o del premio (o di qualsiasi parte di esso) come non consegnabile o, se applicabile, la mancata risposta corretta alla domanda del test di abilità dello Sponsor possono comportare la squalifica del vincitore e la perdita del premio e lo Sponsor può far sì che un vincitore alternativo venga selezionato in modo casuale tra tutte le iscrizioni ammissibili rimanenti.

RESTRIZIONI DI CONTENUTO: I partecipanti non devono includere nessuno dei seguenti elementi (le “Limitazioni di contenuto”) in nessun elaborato: (a) nudità, pornografia, contenuti per adulti o qualsiasi altro materiale esplicito; (b) materiali relativi a lotterie o giochi d’azzardo; (c) blasfemia, immagini di violenza o promozione di attività illegali; (d) contenuti in violazione dei diritti di proprietà intellettuale o delle leggi; (e) materiali calunniosi, diffamatori, denigratori, illeciti o diffamatori; (f) contenuti che denigrino, screditino o riflettano negativamente le Entità Partner, i loro proprietari e dipendenti o lo sport in questione; (g) tabacco, sigarette elettroniche, alcol o droghe; (h) acrobazie pericolose; (i) armi reali di qualsiasi tipo, tra cui, a titolo esemplificativo, pistole, coltelli o proiettili; (j) materiale che promuova il bigottismo, il razzismo, l’odio o il danno nei confronti di qualsiasi gruppo o individuo o che promuova la discriminazione basata su razza, sesso, religione, nazionalità, disabilità, orientamento sessuale, età o qualsiasi altra base protetta da leggi, ordinanze o regolamenti; (k) individui al di sotto della maggiore età senza aver fornito una liberatoria firmata da un genitore o da un tutore legale; (l) contenuti audio e/o visivi di proprietà di terzi (ad es. g., musica registrata, video pre-prodotti, ecc.); e (m) materiale illegale o comunque in violazione o contrario alle leggi o ai regolamenti di qualsiasi giurisdizione in cui l’iscrizione è stata creata. Qualsiasi iscrizione che non sia conforme a quanto sopra, come stabilito a discrezione dello Sponsor, sarà squalificata.

PUBBLICAZIONE, LICENZA E LIBERATORIA DELL’ELABORATO: Accettando il presente Regolamento ufficiale e nella misura consentita dalla legge locale applicabile, ogni partecipante (a) accetta che il proprio elaborato è un’opera originale e che possiede tutti i diritti, i titoli e gli interessi sull’elaborato alla data dell’invio, o ha tutti i diritti e le autorizzazioni necessarie per inviare l’elaborato, compreso il permesso esplicito di tutti gli individui che lo compongono, per l’eventuale utilizzo come previsto nel presente documento; (b) accetta di non violare i diritti d’autore, i marchi di fabbrica o altri diritti di proprietà intellettuale, o i diritti di privacy o pubblicità, di qualsiasi persona o entità; (c) concede allo Sponsor, alle Entità Partner e a ciascuno dei rispettivi incaricati il diritto e la licenza illimitati di utilizzare, concedere in licenza, modificare, duplicare e/o creare opere derivate dal proprio elaborato in tutto il mondo per tutta la durata della protezione dei potenziali diritti di proprietà intellettuale dell’elaborato, compreso il diritto per le Entità Partner di pubblicare, mostrare, trasmettere, distribuire, riprodurre, eseguire, creare opere derivate e utilizzare e sfruttare in altro modo l’elaborato tramite i loro siti web, i social media (come TikTok, Facebook, X, Instagram), gli stadi, la televisione, la stampa e/o qualsiasi altro mezzo di comunicazione attualmente esistente e sviluppato in futuro, senza limitazioni e senza preavviso o pagamento di alcun compenso al partecipante o ai suoi eredi e successori: (i) in proprio o come parte di qualsiasi produzione audiovisiva o di altro tipo; (ii) per pubblicizzare qualsiasi prodotto, programmazione o servizio delle Entità Partner per qualsiasi altro scopo pubblicitario, di marketing e promozionale e in qualsiasi materiale ad esso correlato e/o (iii) per qualsiasi altro scopo; (d) sollevare in perpetuo le Parti esonerate (come definite di seguito) da qualsiasi rivendicazione, richiesta, perdita e responsabilità di qualsiasi natura derivante da o in qualsiasi modo connessa all’iscrizione e all’uso dello stesso come consentito dal presente documento, comprese, a titolo esemplificativo e non esaustivo, rivendicazioni di violazione del diritto d’autore o del marchio, falsa approvazione, calunnia, diffamazione o violazione dei diritti di pubblicità o privacy. Nulla di quanto previsto dal presente documento obbliga le Entità Partner a fare uso di uno qualsiasi dei diritti qui previsti.

RINUNCIA ALLA RESPONSABILITÀ/RILASCIO DELLA PUBBLICITÀ (applicabile solo ai residenti negli Stati Uniti e in Canada): Partecipando al Concorso a Premi, ogni partecipante accetta di (a) essere vincolato dal presente Regolamento Ufficiale, compresi tutti i requisiti di partecipazione, e (b) rinunciare a qualsiasi reclamo nei confronti dello Sponsor, delle Entità Partner e di ciascuna delle rispettive società madri, affiliate, controllate, funzionari, direttori, dipendenti, agenti, licenziatari, distributori, rivenditori, stampatori, rappresentanti, agenzie pubblicitarie e promozionali,e qualsiasi altra società associata al Concorso a Premi, e tutti i loro rispettivi funzionari, direttori, dipendenti, agenti e rappresentanti (collettivamente, “Parti Esonerate”) per qualsiasi lesione, danno o perdita che possa verificarsi, direttamente o indirettamente, in tutto o in parte, dalla partecipazione al Concorso a Premi, dalla ricezione o dall’uso del premio (o di qualsiasi parte di esso), o da qualsiasi viaggio o attività ad esso correlata.

Per i residenti nell’UE e nel Regno Unito: Nessuna disposizione del presente Regolamento ufficiale esclude o limita la responsabilità delle Parti liberate in caso di (i) morte o lesioni personali causate dalle Parti liberate, (ii) danni diretti derivanti dalla violazione sostanziale dei loro obblighi legali da parte delle Parti liberate e/o dalla violazione sostanziale del presente Regolamento ufficiale o (iii) frode, falsa dichiarazione fraudolenta o colpa grave.

RILASCIO DELLA PUBBLICITÀ (non applicabile ai residenti in Germania e Spagna): Accettando il presente Regolamento Ufficiale, i partecipanti acconsentono a che lo Sponsor, le Entità Partner e i loro incaricati e cessionari possano utilizzare in relazione al Concorso a Premi e per una durata di due (2) anni a partire dalla partecipazione al Concorso a Premi, il nome, la voce, la città/stato di residenza, le foto, i video o i filmati del partecipante, per scopi pubblicitari e/o commerciali in qualsiasi mezzo di comunicazione presente o futuro, compresi i siti web, le pagine dei social media (TikTok, Facebook, X, Instagram) o le piattaforme di condivisione (YouTube, Dailymotion), gli e-banner, le e-mail promozionali o il formato presente o futuro senza ulteriore compenso (finanziario o di altro tipo), autorizzazione o notifica. I vincitori concedono allo Sponsor, alle Entità Partner e a ciascuno dei loro rispettivi incaricati il diritto di pubblicizzare in relazione al Concorso a Premi e al premio per una durata di due (2) anni a partire dalla notifica del premio, il loro nome, la città e lo stato di residenza, le informazioni sul premio, le fotografie, i video o i filmati, la voce, le dichiarazioni e/o altre sembianze per scopi pubblicitari, promozionali e commerciali, in qualsiasi mezzo di comunicazione presente o futuro, compresi i loro siti web, le pagine dei social media (TikTok, Facebook, X, Instagram) o le piattaforme di condivisione (YouTube, Dailymotion) o i formati attualmente conosciuti o in futuro ideati, in tutto il mondo, senza limitazioni e senza ulteriori compensi, corrispettivi, permessi o notifiche, a meno che non sia vietato dalla legge.

CONDIZIONI GENERALI: Il computer dello Sponsor sarà l’orologio ufficiale del Concorso a Premi. Le decisioni dello Sponsor prese in conformità al presente Regolamento ufficiale sono definitive e vincolanti per tutte le questioni relative a questo Concorso a premi. Purché non violino i loro obblighi legali o contrattuali, le Parti esonerate non sono responsabili per iscrizioni, trasmissioni, e-mail o posta rubate, in ritardo, incomplete, illeggibili, imprecise, mal indirizzate, perse, mal inoltrate, strapazzate, danneggiate, ritardate, non consegnate, mutilate, in ritardo di spedizione o danneggiate; per la perdita, l’interruzione o l’indisponibilità della rete, del cavo, del satellite, del server, del fornitore di servizi Internet (ISP), della rete wireless, del sito web o di altre connessioni; disponibilità, accessibilità, disguidi o guasti di trasmissioni o linee informatiche, satellitari, telefoniche, via cavo o wireless; malfunzionamenti, guasti o difficoltà dell’hardware o del software del computer; congestione del servizio wireless; guasti o malfunzionamenti di telefoni, linee telefoniche, sistemi telefonici, torri wireless o apparecchiature di torri cellulari; qualsiasi errore, omissione, interruzione, difetto o ritardo nella trasmissione, nell’elaborazione o nella comunicazione wireless o di altro tipo; errori di stampa, tipografici o di altro tipo che compaiono nel presente Regolamento ufficiale o in qualsiasi pubblicità relativa al Concorso a premi o in altri materiali, nella misura consentita dalla legge applicabile; cancellazione o rinvio di qualsiasi gioco/evento/esibizione a causa di un evento di forza maggiore; o qualsiasi altro errore, problema o difficoltà di qualsiasi tipo, sia umano, meccanico, elettronico o di altro tipo, relativo al Concorso a Premi, compresi, senza limitazione, errori o difficoltà che possono verificarsi in relazione alla gestione del Concorso a Premi, all’elaborazione delle iscrizioni, all’annuncio dei vincitori o a qualsiasi materiale relativo al Concorso a Premi. A condizione che non siano in violazione dei loro obblighi contrattuali o legali, le Parti esonerate non sono inoltre responsabili di eventuali informazioni errate o imprecise, causate dagli utenti del sito web (ad esempio, hacking) o da qualsiasi apparecchiatura o programmazione associata o utilizzata nel Concorso a premi. A meno che non siano in violazione dei loro obblighi contrattuali o legali, le Parti Rilasciate non sono responsabili per i danni al computer del partecipante o di qualsiasi altra persona e/o al dispositivo wireless relativi o risultanti dalla partecipazione a questo Concorso a Premi o dal download di materiali dal sito web del Concorso a Premi o dall’uso dello stesso. Le persone che manomettono o abusano di qualsiasi aspetto del Concorso a Premi o del sito web; tentano di minare il legittimo funzionamento del Concorso a Premi con imbrogli, inganni o altre pratiche di gioco sleali; intendono infastidire, abusare, minacciare o molestare qualsiasi altro partecipante o qualsiasi rappresentante dello Sponsor e/o delle Entità Partner; o che violano il presente Regolamento Ufficiale saranno squalificate e tutte le iscrizioni associate saranno annullate. Lo Sponsor avrà il diritto esclusivo di squalificare qualsiasi partecipante per violazione del presente Regolamento ufficiale o di qualsiasi legge applicabile relativa al Concorso a premi. Le parti esonerate (a) non rilasciano alcuna garanzia, fideiussione o dichiarazione di alcun tipo in merito al premio (o a qualsiasi parte di esso) oltre a quelle previste nel presente documento e (b) declinano qualsiasi garanzia implicita. La mancata applicazione da parte dello Sponsor di qualsiasi termine del presente Regolamento ufficiale non costituisce una rinuncia a tale disposizione.  Lo Sponsor e le Entità Partner si riservano il diritto di modificare, sospendere, estendere o annullare il Concorso a Premi (o parte di esso) nel caso in cui lo Sponsor sia impossibilitato ad eseguire il Concorso a Premi come previsto nel presente documento a causa di qualsiasi evento di forza maggiore dello Sponsor, tra cui, a titolo esemplificativo ma non esaustivo: incendio; inondazione; terremoto; esplosione; epidemia o crisi di salute pubblica; controversia di lavoro o sciopero; atto di Dio o nemico pubblico; guasto alla rete o alle attrezzature; sommossa o disordine civile; minaccia o attività terroristica; guerra (dichiarata o non dichiarata); ordine del tribunale; o legge, ordine o regolamento del governo federale, statale o locale. Lo Sponsor e le Entità Partner si riservano inoltre il diritto di modificare, sospendere, estendere o annullare il Concorso a Premi (o parte di esso) nel caso in cui virus, bug, interventi umani non autorizzati o altre cause o eventi, qualificabili come forza maggiore, dovessero compromettere l’amministrazione, la sicurezza, l’equità, l’integrità o il corretto funzionamento del Concorso a Premi. In caso di annullamento, lo Sponsor può decidere di identificare i vincitori e assegnare il premio mediante estrazione casuale tra tutte le iscrizioni non sospette e idonee ricevute fino al momento dell’annullamento. Lo Sponsor si riserva inoltre il diritto, a sua esclusiva discrezione, di modificare il presente Regolamento ufficiale a scopo di chiarimento, senza incidere in modo sostanziale sui termini e sulle condizioni del Concorso a premi.

ATTENZIONE: QUALSIASI TENTATIVO DI DANNEGGIARE DELIBERATAMENTE QUALSIASI SITO WEB O ALTRA PROPRIETÀ ASSOCIATA A QUESTO CONCORSO A PREMI O DI MINARE IL CONTENUTO O IL FUNZIONAMENTO LEGITTIMO DI QUESTO CONCORSO A PREMI PUÒ COSTITUIRE UNA VIOLAZIONE DELLE LEGGI PENALI E CIVILI E, NEL CASO IN CUI SI VERIFICASSE TALE TENTATIVO, LO SPONSOR SQUALIFICHERÀ QUALSIASI PARTECIPANTE RESPONSABILE DEL TENTATIVO E LO SPONSOR, LE ENTITÀ SPONSOR E I RISPETTIVI AGENTI SI RISERVANO IL DIRITTO DI RICHIEDERE DANNI (COMPRESE LE SPESE LEGALI) E ALTRI RIMEDI A QUALSIASI PERSONA RESPONSABILE DEL TENTATIVO NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE.

Le iscrizioni generate da script, macro o altri mezzi meccanici o automatizzati saranno squalificate. In caso di controversia sull’identità o sull’ammissibilità di un vincitore, l’iscrizione vincente sarà dichiarata effettuata dal Titolare del conto autorizzato dell’account dell’indirizzo e-mail utilizzato per partecipare al Concorso a Premi, a condizione che sia idoneo ai sensi del presente Regolamento ufficiale. Per “Titolare dell’account autorizzato” si intende la persona fisica a cui è stato assegnato l’account in questione dall’ISP o da un’altra organizzazione (ad esempio un’azienda o un istituto scolastico). 

ARBITRATO; RINUNCIA ALLE AZIONI DI CLASSE (applicabile solo ai residenti negli Stati Uniti e in Canada): Come condizione per partecipare a questo Concorso a Premi, ogni partecipante accetta che (a) qualsiasi controversia, reclamo, controversia o causa di azione derivante da o relativa a questo Concorso a Premi o a qualsiasi premio assegnato (ciascuno, un “Reclamo”) sarà (i) arbitrato solo su base individuale e non sarà consolidato o unito a o in qualsiasi arbitrato o altro procedimento che coinvolga un Reclamo di qualsiasi altra parte e (ii) risolto mediante arbitrato vincolante nella Contea di New York, New York, davanti a un unico arbitro nominato da JAMS in conformità con le norme e le procedure in vigore in quel momento, e il giudizio sul lodo reso dall’arbitro potrà essere emesso da qualsiasi tribunale avente giurisdizione in materia; e (b) in nessuna circostanza il partecipante potrà ottenere riconoscimenti per, e il partecipante con il presente rinuncia a tutti i diritti di richiedere, danni punitivi, incidentali, consequenziali o di qualsiasi altro tipo, se non per le spese effettivamente sostenute. Per i residenti del New Jersey, le limitazioni di cui sopra possono essere inapplicate nel caso in cui le spese legali, le spese processuali o altri danni siano previsti per legge. 

LEGGE REGOLATRICE E GIURISDIZIONE:

• Se l’utente risiede al di fuori dell’UE, il presente regolamento sarà disciplinato dalle leggi dello Stato di New York. 
• Se l’utente risiede nell’UE o nel Regno Unito, il Regolamento ufficiale è disciplinato dalle leggi del suo paese di residenza e conserva il diritto di intentare un’azione legale presso qualsiasi tribunale locale di giurisdizione applicabile nel luogo in cui risiede. 
• Per i residenti in Italia, si applicheranno le leggi francesi nella misura in cui ciò non vi privi della protezione offerta dalla legge italiana. 

ELENCO DEI VINCITORI: Per ottenere i nomi dei vincitori, inviare una richiesta e una busta affrancata autoindirizzata da ricevere entro novanta (90) giorni dalla Data dell’estrazione a: SERIE A Collector Event Winner List, c/o 5 Avenue du Général de Gaulle, Saint-Mandé, Francia 94160.  L’utente può opporsi alla comunicazione dei propri dati per iscritto inviando un’e-mail a [email protected].
